PROCEDURE STIPULATIONS REGARDING PITT’S PLOTS LEASING

 

Since October 2004 Technological and Industrial Park Timisoara is opperational. So far there were organized four opened public auctions for plots concession in the following dates:

 

*   On the 25th of November 2004 and the 20th of January 2005,

*   On the 7th of September 2005 and the 25th of October 2005.

 

If a Romanian or foreign company is willing to lease a PITT plot, the following steps must be respected:

 

*      It must be bought the Terms of Reference* regarding the PITT’s plots leasing and the PITT’s town planning and development regulations**;

*      It must be sent to the Industrial and Technological Park Timisoara / ADETIM a letter of intention;

*      It must be respected the auction / negotiation participating conditions, the instructions concerning the offers handing in, the procedure stipulations of the auction / negotiation;

 

*      The Terms of Reference consist of:

a)     General data;

b)     Description of the lots destined to the auction;

c)      Investments that are in the task of the leaseholders;

d)     Conditions of exploitation;

e)     The duration of the leasing;

f)       The minimum due;

g)      The obligation of the leaseholder concerning the protection of the environment;

h)      Other clauses;

i)       Condition for participating at the auction / direct negotiation;

k)  The criteria of evaluation;

l)   The participation fee, the price of the documentation.

 

 The Terms of Reference ANNEXES refer to ׃

A.   PARTICIPATING CONDITIONS

 

At the auction / negotiation there will be accepted only the tendered that fulfill cumulatively the conditions:׃

 

*      To be an economic agent registered at the Office of the Register of Trade from Romania or from other state;

*      The main object of activity of the company must respect the fields of activity that are accepted within PITT;

*      Not to be insolvent, in bankruptcy or liquidation stage ;

*      Their administrators not to be convicted in penal lawsuits for crimes;

*      Not to have arrears of payment at taxes , local taxes , the state budget , the local budgets or other obligations or local contributions;         

*      Not to offer false data in the documents of qualification.

 

 

B.   INSTRUCTIONS CONCERNING THE OFFERS HANDING IN

 

In order to participate at the auction / negotiation, the tendered will hand in at the Timiş County Council center, in the place mentioned in the advertisement, two sealed up envelopes, an exterior and an interior one:

*    The exterior envelope will be addressed to the “Timis County Council – the commission of assessment and selection of offers handed in the auction / direct negociation from the date ............ for the field of ................ plots from PITT” and there will be indicated the number / numbers of the plot(s) for which it is bidding, the name of the tendered, the social residence of it, the telephone number or fax, the envelope must contain the PARTICIPATING DOCUMENTS :

*   NECESSARY DOCUMENTS FOR PARTICIPATING AT THE AUCTION / NEGOTIATION REGARDING PITT’S PLOTS LEASING FOR ROMANIAN LEGAL ENTITIES; (DOWNLOAD DOCUMENT);

*   NECESSARY DOCUMENTS FOR PARTICIPATING AT THE AUCTION / NEGOTIATION REGARDING PITT’S PLOTS LEASING FOR FOREIGN LEGAL ENTITIES; (DOWNLOAD DOCUMENT);

*    On the interior envelope there are written the name of the tendered, the social residence of it, the telephone or fax number, and also the envelope content, namely the OFFER.

 

C.   PROCEDURE STIPULATIONS

 

*    All the participants at the auction / negotiation must pay the tax of participation, the cost of the documentation and the guarantee of participation at the pay office of the Timis County Council, or using money transfer in the TCC account opened at the Timisoara Treasury;

*   The offers and the participating documents are handed at the Secretariat of PITT in sealed closed envelopes in order to be registered at until the date of 20 every month, hours 1600, according to the publicity advertisement of participation;

*     The opening the envelopes with the DOCUMENTS OF PARTICIPATION will take place in the presence of all the tendereds on the date of 21 every month, at the residence of Timis County Council, Timisoara, Bv. Revolutiei from 1989, no. ....... room floor ..........;

*     The auction / direct negociation will take place according to the Procedure approved by the  Timis County Council;

  The tendered will lost the participation guarantee if he retires its offer after the limit date for handing in the offer or if being declared winner, refuses to sign the concession contract;

*   The participation guarantee of the tendered declared winner will be kept by PITT until the moment of concluding the concession contract;

*   The conceder is obliged to return the other tendered the participation guarantee during a 7 day period from the designation of the winning tendered;
