concerning the offers handing in, the procedure stipulations of the auction /
negotiation;
The Terms of Reference consist of:
a)
General data;
b)
Description
of the spaces offered for renting;
c)
Conditions
of exploitation;
d)
The
renting duration;
e)
The
starting price / tariff of the rent;
f)
Participating
conditions;
g)
The
modality of pre selecting the participants at the auction / negotiation and the
pre selection criteria;
h) Procedure stipulations.

Anexa 3:Form for selection base of the letter of interest;

A.
PARTICIPATING CONDITIONS
At the auction / negotiation
there will be accepted only the tendered that fulfill cumulatively the
condiţions:׃
To be an economic
agent registered at the Office of the Register of Trade from
The main object of
activity of the company must respect the fields of activity that are accepted
within PITT;
Not to be insolvent, in bankruptcy or liquidation stage ;
Their administrators not to be convicted in penal lawsuits
for crimes;
Not to have arrears of payment at taxes , local taxes , the
state budget , the local budgets or other obligations or local contributions;
Not to offer false data in the documents of qualification.
B.
INSTRUCTIONS CONCERNING THE OFFERS HANDING
IN
In order to participate at the auction / negotiation, the tendered will hand in at the Timis County Council center, in the place mentioned in the advertisement, two sealed up envelopes, an exterior and an interior one:
The exterior envelope will be addressed to the “ADETIM – to the tenants’ selection
commission of the offers handed in within the opened public auction from the
date specified in the advertisement for the space(s) (as it appears within the
advertisement) within PITT’s Administrative Building” and it will be
indicated the number / numbers of the space / spaces for whom the offer is
made, the name of the tendered, the social residence of it, the telephone
number or fax, and also the envelope’s content, namely the PARTICIPATING DOCUMENTS :

On the interior envelope there are written the name of
the tendered, the social residence of it, the telephone or fax number, and also
the envelope content, namely the INITIAL OFFER,
respectively the rent offered by the participant.
C. PROCEDURE STIPULATIONS
All the participants at
the auction / negotiation must pay the tax of participation, the cost of the
documentation and the guarantee of participation at the pay office of the Timis
County Council, or using money transfer in the TCC account opened at the
Timisoara Treasury;
The offers and the participating documents are handed in sealed up
envelopes, closed, at the Timis County Council, ADETIM Secretariat, Revolutiei
din 1989 Bvd, no. 17, fourth floor, office 401, until the date mentioned in the
advertisement;
In order to verify the tendered
firms eligibility, the offers will be opened in the first working day that
follows the deadline for handing in the offers, at 10 00 o’clock
(Romanian time). The place of the offers opening is Timis County Council,
Revolutiei din 1989 Bvd, no. 17, fourth floor, in the session room of ADETIM.
The tendered presence is obligatory;
The auction will take place at the date and place specified
in the announce;
The tendered will lost the participation guarantee if he/she
retires the own offer before the winner designation or if, being declared as
the winner he/she refuses to sign the concession contract;
The participation guarantee of the tendered declared winner
will be kept by PITT until the moment of concluding the concession contract;
The tenant is obliged
to return the other tendered the participation guarantee during a 7 day period
from the designation of the winning tendered;
The place and the date of the negotiations sessions will be
announced by posting them at the ADETIM Secretariat, being at the same time
communicated in writing to the tendered. At the direct negotiation will
participate only the investors that have presented, in the form and the content
specified in the Terms of Reference, the participating documents.
